If compensable, a dependent is entitled to 70% of their workers’ wages throughout the rest of the surviving spouse’s life, or until they remarry. A dependent may include anyone that relied upon the injured worker at the time of the accident or occupational exposure. In terms of children, there is a presumption of dependency as to any natural child under 18, or if enrolled as a full-time student, under 23, who were actually part of the injured worker’s household at the time of their death. The rights of dependent children are actually separate rights of their own. The Workers’ Compensation carrier is also responsible to pay for a portion of the funeral expenses.
