Maybe. In every Workers’ Compensation case, one has to prove that their injury arose from the course of their employment. In a heart-attack case, one must show that the work-effort was “in excess of the rigors of the claimant’s daily living” and that the cause of the heart attack was qualitatively more intense than the strain of the physical activity to which the worker was accustomed to in their leisure time. The Court will ultimately have to evaluate personal risk factors, and the intensity and duration of the work effort leading up to the heart attack.
