New Vermont Law Toughens Workers’ Compensation Compliance

WCAX reports that “A new law stiffens penalties for businesses who don’t carry [workers' compensation] insurance, or who misclassify workers.”

This is part of a Vermont Department of Labor effort to make sure companies not only have workers’ compensation insurance, but are carrying the right kind as well.

“The state labor commissioner, Patricia Moulton Powden, says the law is targeted toward businesses that try to lower costs by classifying employees as independent contractors,” writes WCAX.

Powden says that having the right insurance is a smart choice. An employer could stand to lose everything in a civil law suit if he does not carry workers’ compensation insurance.

According to WCAX, noncompliance among businesses will result in a high fine and inability to bid on any state contract for three years.

OSHA Investigates Under Reporting Work Injuries

The Occupational Health and Safety Administration began a one year investigation to asses the accuracy of injury and illness reports in the workplace.

This new investigation requires the U.S Department of Labor to compile the statistics of workplace injury, illness, or death. Employers are also supposed to keep these records. Record keeping on these incidents is essential to finding the cause of these accidents. OSHA will inspect companies’ records, interview employees, and perform a safety check of facilities.

Coffee Break Injury Gets Full Disability in NJ Case

A New Jersey plumber was driving to get coffee, which he was permitted to do, while waiting for a colleague and was involved in a serious accident.

The New Jersey Division of Workers’ Compensation awarded the man full disability for the multiple broken bones in his arms and legs that were sustained during the accident. The Court found that the man was an off-site consultant who, while waiting to speak to an expert, went to get coffee and was injured.

Worker Death at N.J. Chocolate Processing Plant

Cocoa Services LP has been cited with 5 citations and Lyons & Sons has been cited with 7 from the Occupational Health and Safety Administration after the death of a worker.

OSHA will begin to investigate this accident in July. The worker fell into a tank that converted hard chocolate to liquid chocolate. Some of the violations for both companies include, lack of railing on floor openings or working platforms. They were also cited for a lack of warning signs.

The companies have 15 business days to act upon the citations.

Decrease of Construction Fatalities in NY

In 2009, there has been a decrease in construction activity in New York, which leads to few workplace deaths.

There were three fatalities due to construction accidents in 2009, which is down from 19 accidents in 2008. This is one upside to the down economy. The slower construction business is leading to less fatal accidents. This is not the only reason for less fatalities. Truck Driver Earns Workers Compensation

A truck driver from Virginia was injured on the job. He was first turned down for workers compensation, but after changing counsel, he eventually won a settlement.

The truck driver’s delivery truck broke down and he pulled it over just past the entrance of a building. The driver worked in the back of the truck while he waited for help. While he did this, a truck pulled out of the defendant’s property turned right and stuck the plaintiff’s truck. This caused the plaintiff to hit the windshield headfirst.

The truck driver had a pre-existing neurological condition that was almost asymptomatic before the accident. The accident made it worse. The plaintiff won a settlement after mediation.

NJ Waste Company Cited for Safety Fines

The Solid Waste Transfer & Recycling Inc of Newark has been cited with10 violations by the Occupational Safety and Health Administration for alleged safety and health violations.

Four of the violations carry a fine close to $200,000 and six violations that carry a fine close to $15,000.

The violations were found during an inspection on June 3. The inspection was done as a part of the government’s effort to inspect companies with larger rates of injury and illness.

Forklift Accident Injures Fed Ex Worker

A Federal Express warehouse worker was injured after being pinned underneath a forklift that he was operating in Parsippany.

The worker was leaning out of the forklift when the loaded forks began to press down on his head and chest. He legs remained inside of the forklift. The man suffered severe head and torso injuries. The federal Occupational Safety and Health Administration is investigating the incident.

OSHA cites New Jersey company for $212,400

The Solid Waste Transfer & Recycling Inc. of Newark, N.J. has been cited by the Department of Labor’s Occupational Safety and Health violations.

The proposed penalties total to $212,400. After investigating, OSHA found that the company had 10 willful violations. Two of the serious violations included, blocked exits and inadequate energy control procedures.

The Newark company has 15 days to comply, request from OSHA’s area director, or contest the citations before the commission.

Seven Arrested for New York Workers Comp Scam

Seven people have been arrested in Nassau County for allegedly bilking New York’s workers compensation fund of a combined $50,000.  The seven people either exagerated or outright fabricated conditions in order to continue receiving money from the program.

One man, a social worker, lied about the severity of his head injury, saying that he required a cane and sling.  Investigators witnessed him jogging and weightlifting, after he’d collected $17,000 from the county.  Another man injured his head and back as a construction worker and was paid $8,000 before it was discovered that he was working at a bagel store.  The other suspects range in severity and duration of the theft.
