A New Jersey Appelate Court has upheld the $7 million verdict awarded to the wife of a New Jersey worker who developed mesothelioma as a result of laundering her husband’s asbestos-laden clothing.
The husband was an employee at the Exxon Refinery in Linden, NJ, and was exposed to asbestos during the process of removing insulation from piping at the plant. While the company equipped the workers with helmets, it did not provide respirators, which would have protected against the asbestos.
The first successful legal action taken against a company for irresponsible exposure to asbestos was a similar case in New Jersey. In 1981, a woman sued the Union Asbestos and Rubber Company for her mesothelioma, which she developed after washing her husband’s clothes.
The court rejected Exxon’s counter-claim that the woman (also an ex-Exxon employee) should have been required to seek benefits under workers’ compensation.

Permanent disability benefits are monetary awards for permanent disabilities. Permanent disabilities are injuries that decrease the physical ability of an injured worker.
This means that injured workers do not need to be completely disabled to receive permanent disability benefits. In many cases, workers who receive permanent disability benefits return to their job.

Because of the down economy, workers compensation agencies are seeing a simultaneous rise in the amount of cases being reported, and a decrease in their budgetary allotments to investigate fraud. While hard numbers are difficult to come by when looking at cases of fraud, it is believed that more and more companies and individuals are filing fraudulent workers compensation claims.
However, as this fraud is being committed, investigators are seeing their budgets cut, and the general trend towards more fraud prosecution seems to be flattening out.

According to a 2008 article from the New Jersey Star-Ledger, the 100-year-old workers compensation system in New Jersey often takes years to help employees who have been injured on the job. Every year, the system helps close to 100,000 workers find the medical relief they need in exchange for their promise not to sue their employer. However, the article alleges, the $1.8 billion system causes thousands of injured employees to wait years before they see the benefits they’re entitled. Some workers even die before they receive relief.
To write the article, the newspaper reviewed dozens of cases and hundreds of records over an eight-month period. It found that the system was marred by significant delays, inexperienced judges, and an administrative system that does not properly track its performance.
