How to avoid a workplace injury on ‘Black Friday’

Posted on Tuesday, November 22nd, 2011 at 5:40 pm

The day after Thanksgiving brings extreme savings and heavy foot traffic to retail stores across the United States. These major sales on ‘Black Friday’ attract large crowds that can be unruly and cause mayhem in the stores.

Retail workers need to proceed with caution during their shifts so as to avoid serious injury in the workplace. The Occupational Safety and Health Administration posted helpful tips in order to stay safe while working on this hectic day.

Lines need to be established before the store even opens so there is order when people proceed to the check out area of the store. There should be workers stationed outside as well as inside and they need to have an open line of communication between them in case an incident occurs. It is also important to keep the waiting customers informed of any changes the store may have.

Workplace injuries can happen any day. If you have been injured in a workplace injury, you deserve compensation for your injuries. Please contact the New Jersey workplace injury lawyers of Levinson Axelrod, P.A. by calling 1-800-346-5529 today.

Man will not receive workers’ compensation for injury

Posted on Monday, November 14th, 2011 at 9:39 pm

A man who filed for workers’ compensation has been denied based on ignoring orders to stop what he was doing at work. The court ruled that the pleadings by the supervisor to cease action qualify as a positive work order.

The employee decided that while at work he would take a sledgehammer to a bowling ball. The second time he struck the ball, a piece broke off and became lodged in his eye. As a result, the man lost his eye.

The filing for workers’ compensation held little ground after it was determined he had broke the positive work order to not proceed with his foolish actions while on the job.

Numerous individuals are hurt on the job everyday and deserve compensation for their injuries. If you have been injured on the job and need help filing a claim for workers’ compensation, please contact the New Jersey workers’ compensation lawyers of Levinson Axelrod, P.A. by calling 800-346-5529 today.

Economy causes increase in disability claims

Posted on Wednesday, November 2nd, 2011 at 4:08 pm

The number of people filing for social security disability benefits has been on the rise in these last three years. The poor economy can be regarded as the foremost reason for this boost.

People who are disabled are becoming discouraged in the current job market. Fewer employers are interested in hiring an employee with a disability due to the liability for the company. Therefore, these individuals are turning to disability benefits in order to receive the medical attention they need.

Disabled workers received around $115 billion in payouts through disability benefits in 2010 which is up from $98 billion in 2008. Claims that go through the first time are usually about one third of the applications received.

Social worker denied workers’ compensation

Posted on Wednesday, October 26th, 2011 at 5:03 pm

A 51-year-old social worker working in Joplin, Missouri has been denied workers’ compensation. The man was injured during the devastating tornado that swept through the Joplin area.

He took it upon himself to try to save three mentally handicapped men but it came with a cost. The social worker broke each rib in his body, lost nearly all of his teeth, ruined his shoulder and spent two months in a coma. He did not possess medical insurance at the time of the accident and now has over $2.5 million in medical expenses due to his severe injuries.

Workers’ compensation was denied to him. This decision has caused an outrage, with family claiming that if the social worker hadn’t been working at the time the tornado struck then he wouldn’t have been so severely injured.

Workers comp lawsuit awarded, then reversed by South Carolina Supreme Court

Posted on Friday, September 9th, 2011 at 12:05 pm

A man who was first awarded when he filed a workers compensation lawsuit after developing asbestosis, was then denied once the claim was appealed to the South Carolina Supreme Court.

The worker, Thomas E. Skinner, contracted asbestosis when he was exposed to asbestos in insulation products during the 15 years that he worked for Westinghouse Electric Corp. Skinner filed the lawsuit in 2004 after he was diagnosed with the condition a year earlier. He was then working full time for the National Guard.

According to the claim, Skinner had suffered an accidental injury due to the chronic inhalation of asbestos during his employment at Westinghouse. Although he was first awarded a monetary sum by a workers comp commissioner, Westinghouse appealed the claim.

While a workers compensation panel and a special referee both affirmed the findings, the South Carolina Supreme Court reversed the ruling, since Skinner was actually making more money with the National Guard and was unable to prove that he had lost wages due to the asbestosis.

Union Pacific retaliates against concerned, injured workers

Posted on Monday, August 29th, 2011 at 5:40 pm

Union Pacific Railroad retaliated against three workers who reported concerns over workplace safety, and now faces over $615,000 in penalties.

A conductor who worked for the Omaha-based railroad company was fired when the company’s hotline received multiple complaints from the man about safety concerns such as missing and obstructed roadway signs. He also made note of a supervisor who had violated the company’s safety procedures while conducting a field test.

After another conductor complained about rough spots he noticed on the train track, he was suspended for five days without pay. The third worker, a locomotive engineer who had reported a workplace injury, was also fired from the company.

According to David Michaels, chief of the Occupational Safety and Heath Administration (OSHA), Union Pacific is keeping employees from feeling as though they have the right to report work-related injuries and safety concerns without retaliation taking place.

Workers’ compensation suit filed for victims of oil rig explosion

Posted on Thursday, August 25th, 2011 at 11:16 pm

A workers’ compensation lawsuit has been filed on behalf of three North Dakota men who were severly burned in an oil rig explosion.

On July 25th, the three men were pulling up drilling pipe on a Cyclone Drilling, Inc. rig when the explosion occurred due to gas escaping the well. While one of the workers is being treated as an outpatient for burns to his arms, the other two sustained much more extensive burns across their bodies, as well as septic shock and life-threatening pneumonia.

The lawsuit was filed on Friday against seven different companies for failing to take the correct steps to prevent such an explosion from happening. According to state laws, Cyclone Drilling cannot be named in the lawsuit because the employer is covered under Workers Compensation and the workers were not killed. The goal of the lawsuit is to get the victims compensation for their pain, medical expenses, and loss of future income.
