Workers comp lawsuit awarded, then reversed by South Carolina Supreme Court

A man who was first awarded when he filed a workers compensation lawsuit after developing asbestosis, was then denied once the claim was appealed to the South Carolina Supreme Court.
The worker, Thomas E. Skinner, contracted asbestosis when he was exposed to asbestos in insulation products during the 15 years that he worked for Westinghouse Electric Corp. Skinner filed the lawsuit in 2004 after he was diagnosed with the condition a year earlier. He was then working full time for the National Guard.
According to the claim, Skinner had suffered an accidental injury due to the chronic inhalation of asbestos during his employment at Westinghouse. Although he was first awarded a monetary sum by a workers comp commissioner, Westinghouse appealed the claim.
While a workers compensation panel and a special referee both affirmed the findings, the South Carolina Supreme Court reversed the ruling, since Skinner was actually making more money with the National Guard and was unable to prove that he had lost wages due to the asbestosis.
