The Defense Base Act and Compensating Workers

Workers’ compensation is not applied in the same way for workers in overseas military bases as it does stateside. Workers in these areas are generally employed through government contracts. This means that the system of compensation works according to government rules. As a result, a person may receive payment for their medical treatments, but not through the usual means of filing a claim through a compensation insurer.

To discuss options available for government contractors injured on the job, contact the New Jersey workers’ compensation lawyers of Levinson Axelrod, P.A., at 888-389-COMP today.

What Workers Are Covered Under the Defense Base Act?

The piece of legislation that governs this form of compensation is known as the Defense Base Act. It was passed to extend a compensation program to all American workers located outside the United States who worked on military bases. These individuals can still receive coverage for injuries caused while at work. Individuals affected by this law include:

  • Private contractor employees in military bases
  • Public work contractor employees working for national defense interests
  • Contractors funded through the Foreign Assistance Act
  • Contractors working through the United Service Organizations

This law provides compensation for an injured contractor through the Office of Workers’ Compensation Programs. Processing a claim may take significantly longer through these public systems.
