The states of New Jersey and Ohio have won a $400 million settlement from a company which insured several of their state programs, including workers compensation.
The plaintiffs include several state programs in both states, including workers compensation. They claimed that the company had been making misleading statements to investors, and originally brought the suit against the company in 2004. The insurance company opted to settle out of court to the tune of $400 million, although the terms of the settlement say that the company accepts no culpability, nor admits any guilt.

According to the U.S. Government Accountability Office, a congressional watchdog agency, many companies are under-reporting the number and severity of workplace injuries and incidents. According to the report, about a third of company physicians interviewed said that they had been asked by their employers to provide insufficient treatment for health issues. Approximately half said that their employers asked them to downplay the number and severity of illnesses and injuries.

Seven people have been arrested in New York for defrauding the state’s largest workers compensation insurance carrier of more than $600,000. According to reports, the people arrested include a correctional officer who was claiming workers comp while working as a bouncer, a business using forged insurance documents, and a company owner who was under-reporting the number of people on his paid staff.
Fraud committed against workers compensation insurance carriers is a felony, and it is an expensive drain on the resources of a state that is having serious financial problems.
